C.P.No.D-1844 of 2012
For Katcha Peshi
15.04.2016
Mr. Faheem Memon holds brief for Mr.Fayyaz
Ali Soomro advocate for petitioners.
Mr. Asif Ali Bhatti advocate for respondent No.11.
Mr. Shaharyar Awan, Assistant Advocate
General.
...............
Learned counsel for the respondent
No.11 and learned AAG submit that since the dispute
between the parties is already pending before the Revenue authorities in
respect of subject-land, therefore, instant petition may be disposed of and the
parties may be directed to continue to seek their remedy before the appropriate
forum as provided under the law.
It
appears that through instant petition, the petitioners have alleged harassment
by the respondents and has expressed their apprehension that the private
respondents with the connivance of official respondents will dispossess the
petitioners from their land allotted to them pursuant to Sanad
of Sindh Goth Abad Scheme. Since learned counsel for private respondent No.11
has candidly stated that neither any harassment has been caused to the
petitioners nor they intend to illegally and forcibly dispossess the
petitioners and will seek redressal of their grievance before the appropriate
forum, therefore, instant petition is being disposed of with directions to the
parties to seek redressal of their grievance by approaching the relevant
authority, forum or competent Court of jurisdiction instead of taking law in
their own hands.
Accordingly, instant
petition is disposed of.
