11.05.2016

Mr. Bashir Ahmed Shar advocate for petitioner.

Mr. Shafique Ahmed Leghari, State Counsel a/w Fayyaz Ahmed Jatoi, DC, Khairpur, Qaribullah Soomro, DFC, Khairpur and Talib Hussain Channa, Incharge Wheat Procurement Centre, Pacca Chang.

                                    ..................

Qaribullah Soomro, DFC, Khairpur submits that grievance of the petitioner has been redressed. Such fact is not disputed by learned counsel for the petitioner, who submits that though the entire quota has not been given to the petitioner, however, in substance the grievance of the petitioner has been redressed and the petitioner does not want to press instant petition.

Pursuant to Court notice, Fayyaz Ahmed Jatoi, Deputy Commissioner, Khairpur has shown appearance and submits that all possible efforts have been made to ensure that the growers may be supplied wheat bags without any discrimination, as per policy/quota, whereas, according to Deputy Commissioner, in his District Khairpur in the first phase 11,00,000 wheat bags, which were meant to be distributed amongst the land growers of District Khairpur, have already been distributed. He further submits that if the Secretary, Food Department, Government of Sindh may supply the remaining quota of 1,46,000 wheat bags at an early date, the same will also be distributed among the small land growers without further delay as per policy/quota.

Accordingly, instant petition is disposed of, however, with directions to the Secretary, Food Department, Government of Sindh to ensure that the remaining wheat bags shall be supplied to District Khairpur as well as to other districts of the Province so that the respective District Food Controllers and Deputy Commissioners/Assistant Commissioners shall ensure the distribution of wheat bags amongst the land growers as per policy and quota, without discrimination.

Let copy of this order may be supplied cover-in-hand to learned State Counsel for onward transmission to the Secretary, Food Department, Government of Sindh for compliance.
