C.P.No.D-1651 of 2016
For Katcha Peshi
16.05.2016
Mr. Mujeebur Rahman Soomro advocate for
petitioner.
Mr. Shahzad Gul Kalwar advocate
for respondents 3 to 6.
Mr. Noor Hassan Malik,
Assistant Advocate General.
..................
Pursuant
to Court notice learned counsel for the respondent No.3 to 6 has filed
statement along with annexures, whereas respondent No.2 has also filed statement, which are taken on record and copy supplied to
learned counsel for the petitioner. Learned counsel for the respondent No.3 to
6 submits that the allegations as contained in the instant petition are totally
false and frivolous, whereas, the respondents are lawful owners of the
subject-land and are also in possession and the petitioner has no locus standi
whatsoever to file instant petition.
While
confronted with such position, learned counsel for the petitioner could not
satisfactorily respond to the contention of learned counsel for the respondents
and submits that petitioner will seek remedy in accordance with law by
approaching the appropriate Court of jurisdiction.
Accordingly,
instant petition is dismissed, however, if the
petitioner claims any right or title over the subject-property, he will be at
liberty to file proceedings in accordance with law.
