Through
instant petition, the petitioner has impugned the order dated 14.04.2016 passed
in Cr.MA No.817/2016 by the learned Sessions Judge/Justice of Peace, Ghotki,
whereby, the application filed by the petitioner under Section 22-A & B,
Cr.P.C for lodging FIR against the proposed accused persons, has been
dismissed.
From
perusal of record and impugned order passed by the Justice of Peace in the
instant matter, it appears that pursuant to report of the concerned SHO, the
learned Justice of Peace was of the opinion that neither such incident, as
alleged in such application, has taken place nor any material has been placed
on record. Moreover, the petitioner is disputing over matrimonial affairs with
the proposed accused persons, has approached the Court after lapse of about
three years of the alleged incident.
In
view of hereinabove facts and circumstances of the case, we do not find any
substance in the instant petition, and the impugned order passed by learned
Justice of Peace, prima facie, does not suffer from any error or illegality.
Accordingly, instant petition is hereby dismissed in limine along with listed
applications. However, the petitioner is at liberty to seek alternate remedy by
filing direct complaint in accordance with law.
