Through instant petition, the petitioners have expressed their grievance against the respondents on the grounds that respondents have not decided the application under Section 18 of Land Acquisition Act, filed by the petitioners against the Award passed in respect of their landed property, which according to learned Counsel for the petitioners, has been acquired by the respondents for construction of Karachi-Lahore Motorway Project, Deh Dilwaro, Taluka Ubauro, District Ghotki.

However, while confronted as to maintainability of instant petition, learned Counsel for the petitioners submits that the petitioners will be satisfied and will not press instant petition, if respondent No.2 may be directed to pass appropriate order on the application filed by the petitioners challenging the award passed by Deputy Commissioner, Ghotki @ Mirpur Mathelo in respect of the subject land of the petitioners. Accordingly, instant petition is dismissed as not pressed, however with the directions to the petitioners to approach the Commissioner Sukkur who shall pass appropriate order on the application, which according to learned Counsel for the petitioners, is pending disposal before the Commissioner in terms of Section 18 of Land Acquisition Act, 1894, strictly in accordance with law.

Petition stands disposed of in the above terms along with listed applications.
