Petitioner
and his counsel called absent, no intimation received. Through instant
petition, the petitioner has alleged harassment by police at the instance of
private respondents and has expressed his illegal dispossession from such
landed property, which according to petitioner, belongs to him. Instant
petition was filed on 19.04.2012 and since then it is pending without any
useful progress. The petitioner has not remained vigilant to proceed with the
matter, whereas, from comments filed by the police, the allegations as
contained in this petition against the police have been denied and it has been
categorically stated that police has neither caused harassment nor they have
any concern whatsoever, with the private dispute between the parties over the
landed property.
We are of the view that instant
petition is misconceived, as the petitioner can seek his remedy in respect of
his title and possession over landed property by approaching the proper Court
of civil jurisdiction, whereas, in case of any illegal act by respondents, i.e.
illegal dispossession of the petitioner from his lawful possession over landed property,
the petitioner is at liberty to approach the competent Court as well as police
for registration of criminal case against such persons.
Accordingly,
instant petition is disposed of in the above terms.
