Petitioner and his counsel called absent, no intimation received. Instant criminal transfer application was filed on 21.11.2015 on the ground that the applicant has expressed his no-confidence on the learned Presiding Officer.

Perusal of record shows that no sufficient material has been produced or ground has been raised to seek transfer of the case on the ground of allegation against the Presiding Officer, which otherwise, cannot be entertained as a matter of routine, as it tends to disturb the entire process of criminal trial. After having filed instant criminal transfer application, the applicant has not proceeded with the matter with due diligence. Today, applicant and his counsel are called absent without any intimation. It appears that the applicant has lost interest to proceed with the matter or purpose of filing instant transfer application is served out.

Accordingly instant transfer application is dismissed along with listed application.
