            Pursuant to court notice, Nazir Ahmed Soomro, Chief Engineer (Tech), SEPCO, Sattar Bux Soomro, Director Legal SEPCO and Rajkumar, XEN, SEPCO, Sukkur have shown appearance and vakalatnama has been filed by Mr. T. David Lawrence advocate on behalf of respondents No.6 to 8, who submits that order passed by this court has been complied with and transformer has been re-installed, which part is not disputed by learned counsel for petitioner. He further submits that new C.E.O (SEPCO) has been posted who is at Islamabad hence he could not appear before this court and will appear on the next date of hearing, if the Hon'ble Court may require his personal appearance in Court.

            Since the transformer has been re-installed, hence we condone his personal appearance in court for today. The Chief Engineer (Tech) SEPCO and XEN SEPCO should communicate this order to C.E.O (SEPCO), who is directed to ensure that in Sukkur Region no such incident will take place, whereby the SEPCO authorities in the garb of collecting outstanding bills from the customers, may remove the transformer of those consumers, who are depositing their electricity bills regularly, as it amounts to depriving those consumers their legitimate right to get un-interrupted electricity in this summer season and scorching heat.

            Both the officers have assured that no such incident will take place, however, they may be allowed to take action against the defaulting consumers or the consumers who are involved in theft of electricity, in accordance with law. They have also undertaken that there will be no unscheduled loadshedding, whereas, all possible efforts will be made to ensure that duration of scheduled loadshedding will also be minimized during the month of Holy Ramzan in particular.

            Learned counsel for the petitioners, in view of such undertaking given by the officials of SEPCO authority is satisfied, and does not press instant petition. Accordingly, instant petition is disposed of in the above terms.
