1. On
19.01.2014 following order was passed by this court.
" Learned Additional Advocate General
submits that a division bench of this Court took notice of an incident reported
in news papers, whereupon, pursuant to court’s directions, D.I.G Crime Branch,
Karachi Bashir Ahmed Memon submitted report dated 15.08.2012, wherein it has
been stated that Inspector Inayatullah Soomro, S.H.O P.S Airport Sukkur has
recorded his statement about the incident, wherein it has been stated that he
does not want to pursue the matter or the enquiry any further. It is further
stated that though such incident took place according to which Syed Khursheed
Ahmad Shah get hold of him from Collar and clapped him, however, he has
forgiven him and therefore, he does not want to proceed further with this
matter.
Record shows that on 16.05.2012 when this matter was
taken up for hearing in Court, Inspector Inayatullah Soomro appeared in person
and stated that such incident did occur, occur, however, he stated that matter
has been settled and he does not want to pursue the matter. It was observed by
the Division Bench of this Court in its order that Inspector Inayatullah Soomro
appeared to be in tremendous pressure, therefore, he has made such statement,
therefore, inquiry was directed to be conducted by the I.G.P Sindh.
It is surprising to note that instant matter has been
fixed in court after lapse of considerable time, whereas, no rebuttal or
comments have been filed on behalf of Syed Khursheed Ahmed Shah, on whose
behalf vakalatnama was filed by Mr. Madad Ali Shah Masoomi, advocate.
Accordingly, we deem it appropriate to call Inspector Inayatullah Soomro, who
shall appear in person on the next date of hearing. He may be served through
concerned S.S.P. To come up on 23.02.2016. Intimation notice may also be issued
to Mr. Madad Ali Shah Masoomi, advocate for the next date."
2. Today the learned Additional Advocate General submits
that pursuant to court’s order dated 19.04.2016, a statement duly signed by
Syed Khursheed Ahmed Shah has already been filed on 17.5.2016, wherein, the
alleged incident of 12th May 2012, as reported in the Newspapers has
been categorically denied. Mr.Zulfiqar Ali Sangi Advocate has filed vakalatnama
on behalf of Syed Khursheeed Ahmed Shah and argued that Syed Khursheed Ahmed
Shah categorically denied the alleged incidence, and has submitted that there
is no truth in the allegations regarding abuse of authority, whereas, on
account of irresponsible and improper reporting Syed Khursheed Ahmed Shah has
been falsely implicated with the alleged incidence which never occurred as
reported and the Media created hype to the story of alleged incident.
3. Per
learned counsel, his client being responsible citizen, an elected Member of
Parliament and leader of opposition, cannot even imagine to slap a public
functionary or to create any hindrance in performance of their duties. It has
been further contended that despite repeated notice and opportunities having
been given to the said S.H.O to state his version, has not come forward either
to state such facts on oath or to assist this court to determine the real facts
regarding occurrence of alleged incident as reported in the Newspapers. Today also he is not in attendance, inspite of
notice nor has filed his statement regarding alleged incidence.
4. In
view of hereinabove facts and circumstances of the case, particularly when the
alleged victim has not come forward to support or verify the alleged incident as
reported in Newspapers inspite of repeated notices and opportunities provided
for such purpose, we are not inclined to keep instant matter pending for
indefinite period, whereas, Syed Khursheed Ahmed Shah against whom the
allegations appeared in the Newspapers, has filed a detailed statement, wherein
the occurrence of alleged incident has been denied categorically. We have no
reasons to disbelieve such statement filed by a Public Representative, who is
also leader of opposition in the National Assembly of Pakistan.
5. Accordingly,
instant petition is disposed of in view of the statement filed by Syed
Khursheed Ahmed Shah.

After arguing the matter at some length, when the learned
counsel for applicants was confronted to point out any error or the fraud and
mis-representation resulting in erroneous disposal of the instant petition,
could not satisfactorily respond to such query of the Court and has candidly
submitted that petitioner would not press listed applications, however,
requests that District Returning Officer Sukkur may be directed to comply with
the directions of Election Commission of Pakistan as contained in its letter dated
6.11.2015, and to decide the application of applicant regarding recounting of
votes in accordance with law. Learned counsel for the petitioners submit that
there are certain facts which were required to be brought to the notice of
Election Commission of Pakistan, however, since petitioner was not made party
therefore order has been passed without taking into consideration the
registration of FIR No.144/2015 registered at PS A-Section Sukkur, which shows
that ballot papers were snatched and destroyed by the mob on the day of election.
It has been prayed that District Returning Officer may be directed to hear all
the concerned parties while disposing of the application of the applicant for
recounting of votes in accordance with law.
Accordingly,
listed application is dismissed as not pressed, however, District Returning
Officer Sukkur is directed and to decide the fate of application of recounting
of votes strictly in accordance with law after hearing all concerned parties, without
being influenced with the order of this court dated 17.11.2015.

petitioners are innocent having no nexus whatsoever with the alleged corruption

Qamber-Shahdadkot against whom some enquiry/investigation is pending before NAB authorities relating to
NHA scheme of Additional Carriageway project-2009. However, NAB authorities are
causing harassment and raiding house of petitioners and there is apprehension
that petitioners will be arrested by the NAB authorities and implicate in some
false case. Per learned counsel in the aforesaid enquiry one Khadim Hussain the
then Mukhtiar has been granted protection from arrest by NAB authorities vide
order dated 01.3.2016 in CP No.820/2016 and requests that similar protection
may also be provided to the petitioners who are willing to cooperate with the
NAB authorities in the enquiry/investigation.
Let
pre-admission notice be issued to respondents, learned DAG as well as
Prosecutor NAB Sukkur for 30.5.2016, to be taken up along with aforesaid
petition. Petitioners shall cooperate with the NAB authorities in the
enquiry/investigation, however, they shall not be arrested till next date of

is being continuously harassed by NAB authorities by issuing call up notice, in

2012-2013 by M/S Kaleem Enterprises Transport Contractor. Counsel for the
petitioner submits that from perusal of the enquiry report available at page 27
of the instant petition, it is clear that the petitioner has no role whatsoever
with the alleged offence, however, there is apprehension that the NAB
authorities will arrest the petitioner, which will cause serious humiliation
and injury to the reputation of the petitioner. Learned counsel further submits
that under similar circumstances other accused namely Kaisar Khan has been granted protection from arrest by
NAB authorities vide order dated 27.4.2016 in CP No.1819/2016 and requests that
similar protection may also be provided to the petitioner.
Let
pre-admission notice be issued to respondents, learned DAG as well as
Prosecutor NAB Sukkur for 19.5.2016, to be taken up along with aforesaid
petition. In the mean while, the petitioner shall cooperate with the NAB
authorities in respect of any enquiry/investigation pending against him,

Learned counsel for Railways submits that such property of Railways can only be
allotted to the employees of Pakistan Railways and not to others. In view of
such position, it appears that the petitioner has lost interest to proceed with
the matter which is pending since 2013 without any progress.
Accordingly, instant petition is dismissed for
non-prosecution along with listed application. However, request of the
petitioner if made within prescribed time for allotment of quarter of Pakistan
Railways, may be considered, strictly in accordance with law.
