Petitioner
and his counsel are called absent, no intimation received. Instant petition was
filed on 09.05.2012, whereby the petitioner has sought directions in respect of
her eviction from the house, which according to petitioner was allotted to her
by the District Government in accordance with law. However, after filing instant
petition, the petitioner and his counsel have not remained vigilant to pursue
the matter, whereas, protection was provided to the petitioner vide order dated
09.05.2012 directing the respondents not to dispossess the petitioner except in
due course of law. Comments have been filed on behalf of official respondents,
wherein the claim and the entitlement of the petitioner has
been disputed.
It
appears that in view of comments filed on behalf of respondents, the petitioner
has lost interest to proceed with the instant petition, which is pending since
2012 without any useful progress. Accordingly, instant petition stands
dismissed for non-prosecution along with the listed applications. However, the respondents
shall ensure that the petitioner, if found to be in lawful possession of
subject-house, the legal course may be adopted to get her eviction from such
house in accordance with law.
