            Learned State Counsel submits that instant petition is misconceived and not maintainable as there are allegations against the petitioner that petitioner who is Food Supervisor while posted at PRC, Qeemat Ram, Mirpur Mathelo during crop season 2009-10 had misappropriated 1500 Government wheat bags and caused wrongful loss to the Government in the sum of Rs.38,25,000/-, pursuant to which the respondents after taking approval from the competent authority intended to proceed against the petitioner in accordance with law and in order to prevent any legal action against the petitioner, instant petition has been filed, whereas, in view of pendency of instant petition no action has been taken against the petitioner.

 

            Record shows that instant petition was filed 24.07.2012, however, after having filed instant petition and having received the comments filed on behalf of respondents, the petitioner and his counsel have not remained vigilant to proceed with the matter. It appears that the petitioner has nothing to offer any explanation. Accordingly, instant petition is being disposed of with directions to the respondents to act strictly in accordance with law, whereas, in case of any misconduct or violation by the petitioner, action may be taken against the petitioner, however, after providing an opportunity of being heard.

 

            Accordingly, instant petition stands disposed of in above terms along with listed application.
