After arguing the matter
at some length, learned counsel for the petitioners submits that the
petitioners will not press instant petition and will seek remedy in accordance
with law by filing suit for declaration and injunction before the competent
Court of jurisdiction.
From
perusal of contents of instant petition and the relief sought, it appears that
petitioners without having disclosed their entitlement or lawful possession
over the subject-houses sought declaration on the basis of some utility bills
seeking directions to the respondents not to remove the encroachment over
public lands. Since the petitioners are not pressing instant petition, we are
not inclined to decide this petition on merits, however, would direct the
official respondents to act strictly in accordance with law, whereas, action
against the encroachers over public lands, after due verification, shall be
taken in accordance with law.
Accordingly, instant petition is
dismissed as not pressed along with the listed applications.
