listed application, the petitioner seeks review of the order dated 13.04.2016.
Learned counsel for the petitioner was directed to satisfy this Court as to
maintainability of instant Review application in respect of order dated
13.04.2016, which was passed by consent of the parties, whereas, the petitioner
after having obtained ex parte stay, remained in the subject premises owned by
Pakistan Railways without extension of period from year to year or payment of
rent/license fee, was accommodated and given time to vacate the premises. Moreover,
no valid ground for seeking review has been mentioned except frivolous
allegations and fallacious averments even beyond the pleadings of instant
petition.
Learned
counsel for the petitioner could not satisfactorily respond to such query of
the Court and has filed statement, wherein, it has been stated that petitioner
does not want to press instant application, which is accordingly dismissed as
not pressed. However, petitioner will be at liberty to file legal proceedings
before the appropriate forum for the recovery of the amount, which according to
petitioner, has been invested in the subject premises by the petitioner.
Accordingly, listed application
seeking review of order dated 13.04.2016 is hereby dismissed as not pressed.
