3&4.               It is, inter alia, contended by learned counsel for the petitioner that petitioner earlier filed a CP No.D-927/2016 seeking protection against the NAB authorities who had issued threats to the petitioner to involve him in false case, was disposed of vide order dated 14.03.2016 with the observation that since there is no Reference, Call-up notice issued by the NAB authorities to the petitioner, therefore, petition being apprehensive in nature was dismissed, however, according to learned counsel for the petitioner, recently in daily newspaper “Jeejal” a news has been published in which the NAB authorities have initiated some inquiry/investigation in respect of corruption by the engineers of Irrigation Department District Khairpur, in which the name of the petitioner has also been mentioned and there is serious apprehension that the petitioner will be arrested by NAB authorities without giving him any opportunity to explain his position. Per learned counsel, the petitioner has no role whatsoever with the allegations as contained in newspapers which has been annexed with the instant petition as annexure “B” at page 19, however, petitioner is willing to cooperate with the inquiry/investigation provided protection may be given to the petitioner against the illegal arrest by the NAB authorities.

 

            Let notice be issued to the respondents as well as DAG and Special Prosecutor, NAB for 18.05.2016, in the meanwhile, the petitioner shall associate with the inquiry/investigation pending before the NAB authorities, if any, however, NAB authorities may not arrest the petitioner unless there is some concrete material or evidence against him connecting him with the allegations, which may require cognizance by the NAB authorities. The petitioner is directed to furnish a solvent surety in the sum of Rs.2,00,000/- (two lac) and PR bond in the like amount to the satisfaction of Additional Registrar of this Court.
