is, inter alia, contended by the learned counsel that the petitioner entered
into an agreement for voluntary return of the alleged amount in terms of Section
25(a) National Accountability Ordinance, 1999 with the NAB authorities and thereafter
paid an amount of Rs.1,47, 00,000/- (one crore and forty seven lac), however,
in view of some delay in making payment of the instalments, the NAB authorities
have filed Reference against the petitioner, which is violation of Section 25
(a) of National Accountability Ordinance, 1999. In support of his contention
learned counsel has placed reliance in the case reported as Mahesh Kumar and
another v. Chairman, NAB, Islamabad and others (PLD 2008 Karachi 38). It has
been prayed that since NBWs have been issued against the petitioner he may
admitted to pre-arrest bail as serious humiliation and injury will be caused to
his reputation if he is arrested.
Without
touching the merits of the case, petitioner is admitted to interim pre-arrest
bail, subject to his furnishing a solvent surety in the sum of Rs.10,00,000/-
(one million) and P.R bond in the like amount to the satisfaction of the
Additional Registrar of this Court.
To
come up for confirmation or otherwise on 23.02.2016.
Let notice be issued to the respondents as well as SPP, NAB.
