Mr. Imdad Ali Malik for the applicant.

Mr. Abdul Rahman Kolachi, Assistant Prosecutor General.

Complainant has not shown appearance despite service.

                                     ..............

It is, inter alia, contended by learned counsel for the applicant that the applicant is innocent who has been falsely implicated in crime No.29/2010 of PS, Pir jo Goth under Sections 324, 427, 147, 148, 149 PPC and 7 ATA at the behest of complainant, whereas, there are general allegations against the present applicant and no specific role has been assigned to the applicant with the alleged offence. Per learned counsel, there has been no recovery effected from the applicant who voluntarily surrendered before this Court for obtaining protective bail as he was not aware of the registration of aforesaid FIR and was granted protective bail. However, when he surrendered before learned trial Court, his bail before arrest application was dismissed on the ground of his absconsion. Per learned counsel the applicant has no previous criminal record, whereas, co-accused persons have been acquitted by the trial Court as the matter has been compromised between the parties. Learned counsel further submits that the applicant is willing to face the trial provided he may be released on bail.

Learned Assistant Prosecutor General in view of hereinabove facts and circumstances of the case and keeping in view the role assigned to the present applicant, does not oppose this application.

Accordingly, applicant is granted bail subject to his furnishing a solvent surety in the sum of Rs.50,000/- (fifty thousand) and P.R bond in the like amount to the satisfaction of the trial Court.

Bail application stands disposed of along with the listed application.
