3-4.     Learned counsel for the petitioner states that the petitioner is presently working as Director of Strategic Planning at the Karachi Port Trust. As per the learned counsel he was appointed as Manager on 15.06.2009 in the KPT against the post of Manager (Human Resources) advertised in the Daily Dawn Karachi dated 10.4.2009 and thereafter he was permanently absorbed on 22.11.2011. Learned counsel further states that the matter with regard to verification of the MBA Degree of the petitioner was scrutinized by the respondents as well as by other Federal investigation Agency upon which it transpired that the alleged charge with regard to the MBA Degree of the petitioner was not proved and the matter thereafter was dropped. He further stated that now  to the utter surprise of the petitioner, the respondents have issued him a show cause notice dated 01.02.2017 on the same premise with regard to his MBA Degree calling upon him to show cause as to why his services may not be terminated  on the ground that the degree of the petitioner is not from a recognized educational institute. Learned counsel states that the petitioner apprehends that under the garb of the said show cause notice coercive measures would be adopted against him and the respondents without fulfilling the legal and codal formalities would terminate the services of the petitioner.  According to the learned counsel, the petitioner is now left with no alternative but to file the instant petition. Learned counsel has also placed reliance on C.P. No.D-2446/2016, wherein according to him under identical circumstances not only notices were issued to the respondents but the petitioners were directed to file their replies to the show cause notice and proceedings if any, may continue but the petitioners’ services shall not be terminated till next date of hearing. Contention raised requires consideration. Let notice be issued to the respondents as well as D.A.G for 23.02.2017. The petitioner is directed to participate in the proceedings by filing proper reply to the show cause notice issued to him and proceedings against him would continue however no final decision may be taken till the next date of hearing.
