KHADIM HUSSAIN M. SHAIKH,J:      It is inter alia, contended by the learned counsel for the petitioner that the petitioner, who, per him, is a government contractor, was not issued the blank tender forms for the subject work of the Scheme by the respondents. He, therefore, prays that the respondents may be directed to re-process the auction proceedings by providing the blank tender forms to the petitioner.

2.       Learned A.A.G. has mainly contended that the bidding process had since been completed and the subject contracts have already been awarded to the successful contractors; and that this petition has become infructuous, which may be dismissed. 

3.       From the perusal of record, it would be seen that the last date for obtaining the blank tender form was 26.04.2017, as is reflected from Paragraphs No.5 and 7 of the petition; that the petition does not reveal the last date of submission of tender form by the contractors and opening thereof. On a query, learned counsel for the petitioner has conceded that the last date for obtaining blank tender form was 26.04.2017 and last date for submission of the tender form by the contractors was 27.04.2017 and the opening of the tenders was also on the same date i.e. 27.04.2017.The record reflects that this petition was filed on 02.05.2017 i.e. after five days of the completion of the bidding process. In such view of the matter, the petition is patently misconceived and not maintainable, which deserves to be dismissed.

4.       Above are the reasons of short order announced by us on 12.07.2017, whereby this petition was dismissed being not maintainable.
