Pursuant to Court directions the learned Judge Anti-Terrorism Court, Hyderabad has submitted report dated 05.06.2017 in Crime No. 151 of 2016 registered under Section 384 PPC at P.S Kotri according to which the aforesaid crime is no more being tried by the Anti-Terrorism Court as the record has been returned to the I.O for want of jurisdiction.

Learned Counsel for applicants submits that during investigation the scheduled section of Anti-Terrorism Act, 1997, viz. S.384 PPC has been deleted, whereas, challan after insertion of Section 420/34 PPC has been presented before the learned Civil Judge & Judicial Magistrate, Kotri. Learned Counsel further submits that instant bail application has become infructuous, which may be dismissed as not pressed and the office may be directed to return the surety documents to the surety after proper verification and identification. It has been further prayed that the applicants may be allowed to appear before the learned Civil Judge & Judicial Magistrate Kotri and to execute P.R Bond in accordance with law.

Learned A.P.G did not controvert the above legal and factual position and recorded his no objection for dismissal of this bail application as not pressed having become infructuous.

Accordingly, this bail application is dismissed as not pressed. Office is directed to return the surety documents to surety after proper verification and identification as per rules. However, applicants may appear before the learned Trial Court and execute their P.R Bonds in accordance with law and they shall also appear before the Trial Court regularly.
