Learned Counsel for petitioners under instructions does not press instant petition in respect of petitioner No.31 Raziq Dino Rind who, according to learned counsel has already been appointed on deceased quota. Accordingly, petition in respect of Petitioner Raziq Dino stands dismissed as not pressed.

 After hearing the learned Counsel for petitioners and learned A.A.G at some length and in view of an order dated 10.07.2014 passed by a Division Bench of this Court in C.P No.D-712 of 2013 in the case of Ghulam Hussain and others v. Province of Sindh and others, whereby, similar grievance as expressed in the instant petition has been redressed, we would dispose of instant petition in the following terms:-

1.         That respondent No.2 i.e. Chief Program Manager, Reform Support Unit, Education and Literacy Department Sindh Secretariat, Karachi shall constitute a District Recruitment Committee for the purposes of addressing the grievance of petitions towards their appointments as H.S.T, J.S.T and P.S.T in District Shaheed Benazirabad under the Teachers Recruitment Policy, 2012 within two (2) weeks from the date of receipt of this order, which shall examine the contentions of the petitioners regarding their eligibility however, subject to the condition as laid down in the Teachers Recruitment Policy, 2012.

2.         If the claim of the petitioners regarding their eligibility and entitlement, to be considered for interviews and recruitments as H.S.T, J.S.T, and P.S.T in District Shaheed Benazirabad on merits i.e the basis of marks obtained in N.T.S Test, which according to petitioners, are higher than those who have been considered by the respondents for recruitment process, is found to be correct, then they shall be reconsidered by the DRC in accordance with law and as per Teachers Recruitment Policy, 2012 and if they are found to be eligible in all respects, they may be considered for the recruitment as H.S.T, J.S.T and P.S.T on the vacancies, if available in District Shaheed Benazirabad.

3.         It may be clarified that disposal of instant petition in no manner will be considered to have acknowledged the claim of the petitioners in the instant petition, and the same shall be examined and scrutinized by the Distirct Recruitment Committee strictly in accordance with law as per Teachers Recruitment Policy, 2012 on the basis of material and documents which may be placed by the petitioners before DRC and thereafter, applications filed by the petitioners in this regard shall be disposed of through speaking orders.

4.         It is expected that such exercise shall be completed within two months from the date of receipt of this order.

            Petition stands disposed of in the above terms alongwith listed applications.
