Notice issued to the respondents in ordinary course as well as by fax. As per Bailiff's report, the respondent No.2 has been served but he is called absent. No intimation so far has been received from his side.

Learned counsel for the petitioners submits that the petitioners are Abadgars of Taluka Sobhodero and they approached the respondents No.2 to 4 for providing weight bags/Bardana in terms of Policy Guidelines For Weight Growers Companion CROP-2017. Per learned counsel, till this date, no weight bags/bardana has been provided to the petitioners as per their entitlement.

In such circumstances, in order to ensure for providing Bardana/wheat bags transparently to the petitioners as per Policy Guidelines For Weight Growers Companion CROP-2017, we have already directed the District & Sessions Judge, Khairpur to nominate any Civil Judge & Judicial Magistrate in each Taluka of District Khairpur to monitor the distribution of the Bardana/wheat bags to the petitioners being the growers of wheat crop. The petitioners are directed to approach the concerned Civil Judge & Judicial Magistrate/Monitoring Officer so nominated by the District & Sessions Judge, Khairpur in person or through thier advocate. The concerned District Food Controller, Khairpur is also directed to appear before the said Judicial Officer on 08.05.2017 at 11:00 a.m. The concerned Assistant Commissioner or in his absence the Mukhtiarkar (Revenue) is also directed to be present at the relevant time before the monitoring Judicial Officer.

Let copy of this order along with copy of memo of petition be communicated to the learned District & Sessions Judge, Khairpur. District Food Controller, Khairpur for compliance. In case of non-compliance or non-cooperation on the part of officers of the Food Department as well as Revenue Department, strict action in accordance with law shall be taken against them. Compliance report shall be sent to this Court by the concerned learned monitoring Judicial Officer through their District Judge to this Court.

With the aforementioned directions, instant petition stand disposed of.
