A.P.G for State has informed that the alleged detainees are absconders in Crime
No. 01 of 2016 registered at Police Station, Jhangro,
for offences under Sections 395, 147, 148, 149, 337-A(i), 337-H(2), 384, 506/2 PPC & 7-ATA and are also
required in Crime No. 43 of 2015 registered at Police Station, Jhangro for offences under Sections 395, 384, 506/2, 148,
149 PPC & 7-ATA have
not been illegally detained by the police.
Learned
Counsel for the petitioner while confronted with such position submits that the
petitioners have been falsely implicated in the aforesaid crimes, hence
requests that reinvestigation in respect of the aforesaid crimes may be
entrusted to some honest police officer. Learned A.P.G submits that challan has been furnished in both the crimes in the Court
of competent jurisdiction and petitioner may be directed to seek remedy in
accordance with law, as the alleged detainees are absconders and have not
surrendered before any competent Court of jurisdiction. Accordingly, the
aforesaid both matters are disposed of along with listed applications. However,
the accused persons nominated in above FIRs may be at liberty to seek further
remedy before the appropriate forum/Court in accordance with law.
