1. Overruled.
2. The above titled two bail applications
relate to an incident, which had allegedly taken place on 17.11.1999. The two
F.I.Rs. of this incident i.e. Crime No.94/1999 and 95/19999, Police Station
Civil Lines, District Larkana, were lodged by S.I. Abdul Jabbar Bijarani,
wherein the allegations against the present applicant are for taking out
illegal procession and thus committing offence punishable under Sections
188/341/147/148, PPC.
Submission of learned counsel for
applicant is that both the F.I.Rs. are mala-fide, as no such incident has taken
place. His further submission is that the offences for which the applicant has
been charged, provide maximum punishment upto three years and thus the
applicant is entitled to remain on pre-arrest bail, as already ordered by this
Court on 02.12.2008.
Mr. Iqbal Kalhoro, Addl. Prosecutor
General, Sindh after going through the relevant record, concedes that it is a
fit case where the applicant is entitled to be admitted on pre-arrest bail.
In view of the above, in both these bail
applications, the interim pre-arrest bail granted to the applicant on
02.12.2008 is confirmed in the same terms.
Disposed of.
