request of learned counsel for the applicants/accused bail before arrest
application is converted to protective bail. Applicants/accused Jan Muhammad Katiyar, Haji Siddique Katiyar, Khamiso Solangi, Ali Muhammad
Shah, Haji Muhammad Katiyar and Ibrahim Katiyar seek protective bail in Crime No.26/2015,
registered at P.S. Ladiyoon, District Thatta under sections 302, 337-H/2, 147, 148, 149, 114, PPC read with sections 6/7 Anti-Terrorism Act, 1997.
It is inter
alia contended that applicants/accused have been involved in this case by the
complainant for political reasons. Serious mala fides on the part of the police
and complainant have been alleged.
Without
touching the merits of the case, protective bail for a period of five (05) days from today is granted to
applicants/accused Jan Muhammad Katiyar, Haji
Siddique Katiyar, Khamiso Solangi, Ali Muhammad Shah, Haji Muhammad Katiyar and Ibrahim Katiyar, subject
to their furnishing solvent surety in the sum of Rs.75,000/-
each and P.R. bond in the like amount to the satisfaction of the Nazir of this
Court. Applicants/accused are directed to surrender
before the trial Court in the aforesaid period. They
are further directed to co-operate with the investigating officer. This order
shall cease to have its effect after expiry of five (05) days from today or
when the applicants/accused surrender before the
trial Court which one occurs
earlier. It is made clear that in case applicants/accused failed to surrender
before the trial Court within the aforesaid period their bail bond shall stand
forfeited.
Application is accordingly disposed
of.
