1.       Urgent application is granted.

2.       Granted subject to all just exceptions.

3.       This is an application submitted by legal heirs of deceased surety, namely Abdul Lateef, for return of surety documents as well as for deleting the entry, which was kept in the Revenue Record.

          Mr. Shahid Ahmed Shaikh, learned A.P.G. present in Court waived the notice of this application.

          It appears that applicant/accused Abdul Ghafoor was granted bail by this Court vide order dated 28.01.1992 in the sum of Rs.100,000/- and P.R. Bond in the like amount.

          As per report of the Additional Registrar of this Court, Abdul Lateef S/o Abdul Wahid Soomro stood surety and produced solvency certificate, it was accepted. Applicant/accused Abdul Ghafoor and others have been acquitted by learned trial Court vide judgment dated 18.12.1994, passed in Sessions Case No.03/1992 (Crime No.152/1991 of Police Station Market, Hyderabad, under sections 392/34 PPC). Applicants (legal heirs) stated that surety Abdul Lateef has expired. Learned A.P.G. recorded no objection.

          In view of above, the instant application is allowed. Additional Registrar of this Court is directed to return the surety documents to the legal heirs of deceased surety Abdul Lateef after proper verification and identification and the concerned Mukhtiarkar may be directed to delete the relevant entry made in the record of rights on the property of deceased surety Abdul Lateef.
