The petitioners have challenged the order dated 24.08.2015, whereby on the basis of alleged period of absence from their duties without any prior permission or information, the petitioners were placed under suspension with immediate effect. Learned counsel for the petitioner argued that though the suspension order was issued but the salaries of the petitioners have also been stopped without any lawful authority and justification, as even under suspension period the salary cannot be stopped. He further submits that the petitioners are ready to join inquiry, if any, in accordance with law but the matter has been delayed since the date of suspension no further action has been taken, neither any show cause notice has been issued nor any inquiry has been constituted.

 

On this statement, learned A.A.G submits that the petition may be disposed of with the directions to expedite the matter within a reasonable period of time. He further submits that if Competent Authority will feel to conduct inquiry proceedings, same will be initiated within a period of one month. So far as the question of non-payment of salaries is concerned during suspension period, the competent authority shall also decide the same.   

 

By consent, the petition is disposed of in the above terms alongwith pending applications.
