Petitioner’s nomination papers were rejected on the ground that his proposer and seconder were enrolled in Ward No. 2 whereas the petitioner is contesting election from Ward No. 3. Learned counsel for the petitioner contended that petitioner is not contesting election from Ward No. 3 although he has filed his nomination papers for Ward No. 2 of UC-16. On a query, learned counsel states that due to a minor defect in the nomination papers the same are rejected without giving an opportunity to amend it. In this regard he referred Section 35(3) of the Sindh Local Government Act, 2013, which is not relevant and speaks about holding of council elections. In our view, the petitioner is not entitled to contest election. Therefore, the petition is dismissed.

Petitioner’s nomination papers were rejected on the ground that proposer and the petitioner are enrolled in Ward No. 2 while petitioner’s seconder is enrolled in Ward No. 4 whereas the petitioner is contesting election from Ward No. 2, hence the petitioner stands disqualified. The petition is therefore dismissed.
