            Vide order dated 25.05.2014, this matter was adjourned at the request of learned counsel for the P.I.A that similar controversy is pending in the Apex Court, therefore, by consent the matter was adjourned. Now, learned counsel for the Respondents submits a copy of order passed by the Apex Court in Civil Appeal No.213-K of 2010 reported in 2015 SCMR 1545, copy has been supplied to the learned counsel for the petitioner. Since the controversy has already been resolved and time and again, the Apex Court has held that in the event of non-statutory Rules, the writ is not maintainable. Learned counsel for the petitioner fairly conceded and does not press this petition, however, he wants to avail appropriate remedy in accordance with law which is otherwise his right to avail.

            The petition is disposed of.
