The petitioner is Assistant Excise & Taxation BS-16 and is performing his duties under the supervision of Director Excise & Taxation at Sukkur. He has challenged the order dated 14.07.2015 whereby he was transferred from the post of AETO, DIO, Sukkur to the post of AETO, Thatta. Matter is fixed for non-prosecution but neither the petitioner is present nor his counsel. This is a fact that the petitioner is a civil servant and his transfer is one of terms and conditions of his service, therefore, keeping in view the bar contained under Article 212 of Constitution of Islamic Republic of Pakistan, 1973, this petition is not maintainable which is dismissed accordingly.
