            It is contended by the learned counsel for the petitioner that instant petition has become infructuous, as according to him, the Appellate Tribunal, Inland Revenue has decided the appeal against the petitioner, which is assailed by them by filing a Reference before this Court, therefore, the petitioner does not intend to proceed with the petition and requests that the same may be disposed of.

            Accordingly, instant petition stands dismissed as having become infructuous alongwith the listed applications.
