By consent of the learned counsel for the parties, instant petition is being disposed of in the following terms:-
i. That the respondent’s department will not adopt any coercive measures for the recovery of subject demand, which is subjudice before the Commissioner (Appeals-IV), Regional Tax Office, Karachi, who may decide the appeal, preferably, within a period of one month from the date of receipt of this order.
ii. In case of any adverse order, if passed by the Commissioner (Appeals-IV) and the petitioner intends to prefer an appeal before the Appellate Tribunal Inland Revenue, the respondent’s department shall not enforce the recovery proceedings for another seven days from the date of receipt of such order.
The Petition stands disposed of in the aforesaid terms alongwith listed applications.
