Learned counsel for the petitioner has submitted an application for condonation of absence of the petitioner for today. Learned counsel for the petitioner states that his client is not aware of today’s date as this matter was not fixed by Court. According to the counsel, his client has proceeded abroad and he  candidly conceded that he did not obtain permission from the Court to proceed abroad.  It is a settled law that the grant of interim pre-arrest bail is an extra ordinary concession given to the petitioner and should not be subjected to abuse/misuse. In this case the petitioner was abroad at his own risk and took it for granted that his absence would be condoned if the matter was fixed for hearing. Regrettably it is becoming an increasing trend for person on ad-interim pre-arrest bail absenting themselves from personal appearance on one pretext or another in total disregard of the fact that pre-arrest bail is an extraordinary concession which has been given to them and must not be abused or misused. In these circumstances, we hereby recall the order dated 02.11.2015 granting interim pre-arrest bail to the petitioner.
