Civil Procedure Code, 1908, Section 12 (2) CPC.
It further appears that the same counsel who had filed his Vakalatnama on behalf of the respondent moved the application under Section 12(2) CPC on behalf of the respondent through a stranger, claiming himself to be the President of respondent No.1 without producing any evidence regarding his authorization in this regard. From perusal of the application under Section 12(2) it further appears that no new facts or the instance of alleged fraud and misrepresentation by the appellant/plaintiff has been pointed out. Similarly, perusal of the impugned order shows that the learned Single Judge in chamber appears to have re-examined the entire judgment and decree and on the same set of facts appears to have given a different opinion from the one already given in the impugned judgment and decree dated 14.03.2006 and 20.04.2006 respectively.
Scope and the application of Section 12(2) CPC is very limited and could only be attracted in cases where the judgment and decree has been obtained by misrepresentation or by playing fraud on the Court by a party. Though an application under Section 12(2) CPC can be filed by a stranger to the proceeding but such applicant has to show that he is an aggrieved party and the impugned order/judgment has been obtained by misrepresentation and fraud. In the instant case, it was found that the respondent/applicant has miserably failed to discharge such burden.
Accordingly the appeal was allowed and the order passed by the Single Judge was set aside.

No rule is prescribed under Sindh Public Procurement Rules, 2010, whereby on rejection of a tender to the lowest bidder, the second lowest bidder can be considered as the successful bidder on the same terms but the same states that negotiations with the bidder are not permissible in terms of Rule 52 and 83 of the Sindh Public Procurement Rules 2010. It is trite principle of law that a public functionary while performing function under the law, rule and regulation, is required to adhere to such law, rule and regulation in its letter and spirit. The discretion vested in a public functionary is to be exercised strictly in accordance with law in a reasonable and transparent manner and not under a colorful exercise of authority.
Though, while exercising constitutional jurisdiction, there is no absolute bar in entertaining the grievances of the aggrieved person against the orders or actions of public functionaries, however, such discretion is to be exercised rarely in cases where there is some jurisdictional error or gross violation of law and the alternate remedy is not considered to be efficacious under the facts and circumstances of the case.

In such circumstances, the case is remanded back to the respondents to examine the claim of the petitioner strictly in accordance with law and the relevant rules and dispose of the same within a period of seven days after providing proper opportunity to the petitioner and if the petitioner still fails to justify his claim he may avail the alternate remedy before the forum provided in terms of Rule 31 of Sindh Public Procurement Rules, 2010, whereafter the petitioner may avail any other remedy as available to him under the facts and circumstances of the case.

Petitioner sought protection and quashment of F.I.R. Petitioner herself admitted the fact of consummation of marriage and of entering into a valid contract. (a) Taxation---
Distinction between direct and indirect taxes stated----
The federal taxes including customs, excise duty and sales tax are indirect taxes, the burden of which is always borne by the end, consumers and not by the seller/registered person or importer/assessee. Whereas in direct taxes such as income tax and wealth tax, burden is borne by the person upon whom the tax is levied. In other words, in indirect taxes the assessee, importer or the registered person is only an intermediary or a tax collecting agent. In case of indirect taxes due to an inbuilt mechanism, the duty or taxes are inclusive in the cost/value of the goods sold, therefore, the same passes on to the end consumer at the time of such transaction.
(b) Sales Tax Act (VII of 1990)---
----Ss.3(B) & 66---Central Excise Act (I of 1944), S.3(D)---Sale of pay-phone cards by Pakistan Telecommunication Company Limited through its sale agent, a tele-card company----Collection of sales tax and excise duty on gross amount of such cards---Refund claim by tele-card company (applicant)---Validity---In sale of air time service, role of applicant was nothing more than merely of sale agent of PTCL and not provider of such service---Amount of duty and taxes charged on such cards was included in their cost, which had been paid by end customers while purchasing such cards---Applicant being a intermediary and not provided of such service could not claim refund of such taxes/duty---Refund claim was rejected in circumstances.

No substantial ground, justifying filing of leave to defend application was raised by the appellant; hence the same was rightly dismissed by the learned Banking Court.
Section 10 of subsection (6) of the Ordinance, 2001 provides that an application for the grant of leave which does not comply with the requirements of subsections (3), (4) and (5) of section 10 of Ordinance (XLVI of 2001), the same shall be rejected unless the defendants are able to show sufficient cause for their inability to comply with any such requirements. In the instant case neither appellant complied with the requirements of section 10 nor has any plausible explanation or sufficient cause been shown.
Held that compliance of the provisions of subsection (3), (4) and (5) of Section 10 is mandatory and the non-compliance whereof would follow the penal consequences as provided in terms of Section 10(6).
In the circumstances, no substance was found in filing the appeal, which was dismissed alongwith listed applications with cost against the respondent No.1 and with special cost against the respondents No.2 and 3 by a short order dated 05.11.2010.
While dismissing the appeal by a short order, the counsel for the respondents No.2 and 3 was directed to file certificate of professional fee and the cost who appears to have filed the certificate dated 15.11.2010, wherein it has been stated that an amount of Rs.50,000/- from each of the respondents has been charged as professional fee. Accordingly, in addition to cost of the petition against the respondent No.1, an amount of Rs.25,000/- as special cost to be paid by the petitioner to the respondents No.2 and 3 was imposed.
