It is stated in the FIR that her daughter Khushboo was married to Applicant Dildar. Dildar used to beat her daughter. On17-7-2016 she was informed by her brother named Mushtaq Ahmed that Khushboo had been poisoned by Applicant Dildar, his parents Applicants Mir Khan and Hasina and his brother Hajan and that she is serious condition and he istaking her to civil hospital Daur. The final medical report bearing number PMCHNSBA/679/2017 dated 28-9-2017 concluded that no poison has been detected. The medical report further concluded that due to decomposition of the body, the cause of death cannot be ascertained however bone injury and poison has been excluded. The F.I.R. is delayed by nearly 5 months. It appears from the prosecution case that some time was consumed in the complainant filing a section 22- A, B Cr.P.C. Applicant Gul Bahar was not nominated in the present F.I.R. Neither, the learned DPG nor his own counsel can explain how and when he was included in the case. Neither does the challan filed by the police reveal any detail . Pre-arrest bail granted earlier to applicants Mir Muhammad, Mst. The Petitioner has assailed the legality of the above-specified Corrigendum whereby Respondent-Board changed the academic qualification of candidates as well as the upper age limit from 62 to 65 years for the post of Vice-Chancellor of Peoples University . We in the aforesaid circumstances hold that the recommendation of the Search Committee to the competent authority for the appointment of Vice-Chancellor PUMHSW, Shaheed Benazirabad in pursuance of corrigendum as discussed supra was without lawful authority and awarding marks to the candidates by the Search Committee is also held to be against the clear command of the Honorable Supreme Court in the cases discussed in the preceding paragraph. Accordingly, we direct the Search Committee /competent authority to hold a fresh interview of the shortlisted candidates made before the issuance of corrigendum and make recommendation to the competent authority for the appointment of Vice-Chancellor, PUMHSW, petitions are disposed of. (Respondent) 30-JAN-24 Yes It seems that while the claim of the bank is being multiplied continuously with the passage of time, whereas, the value of the property as determined in the year 2016 was fixed to be set off against current exaggerated claim of Bank. This is no justification. No one should suffer on account of court???s error whether it is a borrower or the bank. If at all the claim is to be set off, it should be set off in terms of the present market value and not on the basis of value of 2016 against claim of bank, as exist now. Six years have been passed and the properties must have been multiplied manifolds, which was not accounted. At the most, since an appeal was pending before this Court and the machinery of execution was not triggered, the application that was inadvertently moved as an execution application could at the most be considered for triggering machinery of the Banking Court where the suit was decreed and converted into execution application. This Article originally had two clauses, of which the second was omitted by the 8th Amendment in 1985. two changes made by the 18th Amendment, one was necessitated by the omission of the Concurrent List, and need not detain us. The other, which will require some comment, was that originally Article 144 applied only if two or more Provincial Assemblies passed the necessary resolutions. The present Constitution of course had two Legislative Lists on its commencement. The competences listed in the Federal List were exclusive to the Federation, those on the Concurrent List were common, and those which were not enumerated were exclusive to the Provinces. VThat ability of course is one of the defining characteristics of federal legislative power, since in respect of matters that lie in the Federal domain by right Parliament can make laws for the whole of Pakistan or any part thereof. It would be unduly restrictive of the purpose and intent behind Article 144 if Parliament, while making the law for which it has been given power cannot include therein provisions that relate to matters in the Federal domain as of right. Secondly, a provincial law made subsequent to the law made by the Federation under Article 144 may override or impliedly repeal the latter. This follows directly from the express provision that the Provincial Assemblies may amend or repeal the law made by Parliament. The 1976 Act, in like manner, fractured and receded. It became provincial legislation and hence territorially bound. It now so operates in this and all other Provinces. It must be kept in mind that this position has remained unaltered, and is unaffected by the enactment of the DRAP Act under Article 144. Whatever may be the relationship of, and interaction between, the two laws, the 1976 Act does not now transcend or cross provincial boundaries in the manner of the DRAP Act. It is therefore our conclusion that in the present case, the scope of the legislative competence entrusted to Parliament in terms of Article 144 is governed by the terms of the resolution passed by the Punjab Assembly. Within 30 days of announcement of judgment the Authority under the DRAP Act shall issue proper guidelines, Simultaneously with posting the guidelines on its website, the Authority shall issue notice to each petitioner in the petitions to which this para applies. Interim orders made in any petition to which this para applies shall continue but will lapse 30 days from the date on which the guidelines are posted as above or the date on which the determination is made, whichever is later. following petitions are dismissed: CP D-4387/2014 and CP D-1684/2017. e following petitions are disposed off in terms of para 50 herein above: CP Nos. And then the Court went on to observe that even if there is a decree of the Court, the stamp duty would be payable as per Valuation Table. Though on facts the said judgment is not relevant; nonetheless, since it has been cited before this Full Bench, therefore, we are compelled to hold that we do not approve such observations made by the Division Bench in the aforesaid paragraph. Had it been in performance of decree, an instrument is being registered, it ought to be on the basis of value determined in the decree and/or agreement entered into for which performance is to be made in terms of Court decree. In such situation there was no occasion for altering/undervaluing the property to avoid stamp duty as the value is already determined by Court of law or decree. It is only in case when the property has changed its status lawfully i.e. from a built-up property to an open plot or from a semi-constructed property to a fully constructed property, the value of the property may be altered in instrument sought to be registered. Thus, when the property sold out on the basis of a decree, which decree has valued the property in question, then the right of valuing the property does not rest with the vendor and vendee and/or the concerned authority. In the instant matter, a decree is passed under summary chapter against an individual who has not executed any negotiable instrument and hence could not have been subjected to summary proceedings. Certainly, if the presence of appellant/defendant No.2 was necessary and important in the wisdom of plaintiff/respondent No.1, in the sense that he was a guarantor or that amount could be recovered from him, then the case could have been proceeded against them/him under ordinary civil jurisdiction. When confronted, Mr. Fazal ur Rehman that this decree could not have been passed under summary chapter against him and/or could not be executed against the appellant, learned counsel for the respondents though initially insisted that it was a belated attempt on the part of the appellant to raise this point, but later conceded as no limitation would run against an order which is a nullity or without jurisdiction in the eyes of law. Samina that if she would not sing a song in standing position, then she may be ready for death Tarique Ali Jatoi fired at his wife Mst. Samina, when she was giving instructions to her co artist . She died It was told by the lady doctor that baby in womb of Mst. Samina had also died. The complainant who is the husband of the deceased had changed his entire version given by him in the FIR at the time of recoding his evidence. He completely exonerated the appellant. In the FIR he shows himself as an eye witness while during his examination-in-chief he deposed that he was informed through phone that his wife sustained firearm injury on such he rushed at hospital where he came to know that his wife has already died. Two more eyewitnesses not supported the case of prosecution. Both the witnesses exonerated the appellant and not supported.
